This license agreement (the “License”) is a contract between you and EURL ZENATI (“we”, “us”), the publisher of Séance. It covers the Séance app for Mac, its updates and its documentation (the “Software”). By installing or using the Software, you accept this License; if you do not accept it, do not install or use the Software. When you buy a lifetime license, our terms of sale also apply.
This English version is a translation provided for convenience. In case of discrepancy, the French version prevails, to the extent permitted by the law of your country of residence.
Summary
- You can try Séance free for 14 days.
- The lifetime license, bought once, covers all your personal Macs, for you and your household, with no time limit and with every update.
- Séance is for private use: no commercial use, no public screenings.
- Only add videos you have the right to watch.
- The Software remains our property: do not copy it, modify it or get around its protections, except where the law allows it.
- Your consumer rights remain fully intact.
Definitions
- License key: the personal code you receive by email after purchase, which activates the lifetime license.
- Household: you and the people who usually live with you.
- Personal Mac: a Mac computer that you own or use privately.
- Your content: the videos, subtitles, images and other files you add to Séance.
Ownership
The Software is a work protected by copyright. It is licensed to you, not sold: we remain its sole owner, except for the third-party components mentioned below, which belong to their authors. All rights not expressly granted to you by this License are reserved.
Trial license
From the first launch, we grant you, free of charge and for 14 days, the personal, non-exclusive right to install the Software on your personal Macs and to use all of its features in order to evaluate it, under the terms of this License.
The trial does not commit you to anything. When it ends, you need a lifetime license to keep using the Software; your videos are left untouched, and your library and settings stay on your Mac. Do not try to extend the trial by artificial means (reinstalling, changing your Mac’s date…). The trial license cannot be transferred.
Lifetime license
Once you have bought a license and activated your key, we grant you a non-exclusive, worldwide right:
- to install and use the Software on all your personal Macs, with no limit on their number;
- to let the members of your household use it on those Macs;
- for strictly private use, neither commercial nor professional;
- for the whole term of copyright protection of the Software, with no further payment, subject to the section “Termination”;
- including every update we release.
Activation
To activate the lifetime license, you enter your key in Séance; no account is needed. The key is personal: do not publish it or share it outside your household. If you lose it, we can resend it to the email address used for the purchase.
If online verification of the key ever became necessary, it would be limited to the key and the technical information strictly required, and we would update this License and our privacy policy before it goes live.
What the law allows
In accordance with Article L122-6-1 of the French Intellectual Property Code, which implements Directive 2009/24/EC, and notwithstanding any other provision of this License, you may:
- make a backup copy of the Software where necessary to preserve its use;
- observe, study or test the functioning or security of the Software in order to determine the ideas and principles underlying any of its elements, while performing any loading, displaying, running, transmitting or storing that you are entitled to perform;
- reproduce or translate its code where this is indispensable to obtain the information needed to achieve interoperability with independently created software, under the conditions and within the limits set by that article.
We reserve the right to correct errors in the Software, as that article allows.
Restrictions
Except where the law expressly allows it, or with our written permission, you agree not to:
- copy the Software beyond what this License allows, or rent, lend, resell, sublicense or make it available to anyone outside your household, subject to the transfer described below;
- use it for commercial or professional purposes, or for public screenings, even free ones (cinemas, bars, hotels, shops, events, online streaming…);
- modify, adapt, translate, decompile or disassemble it;
- bypass or disable the trial period, the key verification or any other technical measure, or create, share or sell keys;
- remove or hide copyright, license or attribution notices, including those of TMDB, TVmaze and FFmpeg;
- use the Software to extract in bulk, reuse or redistribute the information and images provided by third-party data services;
- use the Software unlawfully or in breach of the rights of others.
Your content
Séance does not provide, sell, download or share any movies, series or videos. You add your own content and you are solely responsible for it. You agree to:
- only add files that you have the right to hold and watch: your own home videos, works you have acquired or that are released under a free license, or copies made from a lawful source within the limits allowed by law;
- only watch them in a private setting, within your family circle: Séance must not be used for public screenings, even free ones.
Séance cannot be used to circumvent technological protection measures (DRM). Your content stays on your drives: we have no access to it.
Your files
Séance does not change or move your files unless you ask it to:
- “Ranger mes fichiers” renames and moves files on the same drive, after showing you a preview that you confirm; you can undo the latest operations;
- “Rapatrier sur ce Mac” copies titles from an external drive to your Mac; the originals are left unchanged.
No feature of Séance deletes your videos. As with any file operation, check the available disk space and keep an up-to-date backup of your videos, for example with Time Machine.
The kids mode filters titles using the age ratings and genres available from data services or your own files. This automatic filtering may be imperfect: it is no substitute for adult supervision.
Third-party data services
To show title information, Séance queries third-party services directly from your Mac: TMDB (only if you have entered your own TMDB API key), TVmaze, Apple’s iTunes Search API, Wikidata, Wikipedia and Wikimedia Commons. The information and images obtained:
- belong to their authors or to the services that provide them, and remain subject to their terms: TVmaze data under CC BY-SA 4.0, Wikidata data under CC0, Wikipedia text under CC BY-SA 4.0, Wikimedia Commons images under various free licenses;
- are provided to you for your personal use within Séance;
- are not checked by us: they may be incomplete, inaccurate or contain spoilers;
- depend on services we do not control, which may change, restrict or stop their service.
Titles are recognized from your file names and from these services: a title may be misidentified, in which case you can correct it with “Corriger l’identification”. If you enter your own TMDB API key, you must comply with the TMDB API terms of use. This product uses the TMDB API but is not endorsed or certified by TMDB.
Offline mode (Réglages › Métadonnées) stops all requests to these services.
Apple Intelligence
On compatible Macs, Séance uses Apple Intelligence for some features: “Précédemment…” (previously on) recaps, translation of synopses into French, and suggestions. These texts are generated automatically, on your Mac, by Apple’s model: they may contain errors or inaccuracies. Their availability depends on Apple (compatible Mac, language, region, activation), and the use of Apple Intelligence is subject to Apple’s terms. You can turn these features off in Réglages › Métadonnées.
Third-party components
The Software includes or uses third-party components that are subject to their own licenses and that we do not own. Those licenses prevail for the components concerned: this License, including the “Restrictions” section, does not restrict any right they grant you, in particular the right to modify or replace those components and to study how they work.
In particular, Séance includes FFmpeg (the ffmpeg and ffprobe tools), open-source software used to play certain formats, in a build licensed under the GNU LGPL version 2.1 or later. FFmpeg belongs to its authors (see ffmpeg.org), who license it to you directly under that license; the license text and the source code corresponding to the version supplied are available from the Credits page. The other credits are shown in Séance (Réglages › À propos) and on the same page.
Updates
We may release updates: fixes, security, compatibility and improvements. Every update we release is included in the lifetime license. We supply the updates needed to keep the Software in conformity for at least two years from your purchase, as set out in our terms of sale.
We let you know when updates are available, and we recommend installing them. If we have told you that a necessary update is available and what happens if you don’t install it, and you do not install it within a reasonable time, we are not responsible for a lack of conformity resulting solely from that, unless this is due to shortcomings in our installation instructions. No updates are owed during the trial.
Each update is governed by this License, in the version in force when the update is released, without reducing the rights you have acquired.
Transferring your license
You may transfer your lifetime license to someone else, in one go and in full, provided that you tell us by email, giving the new holder’s email address, and that you then stop using the Software and remove it from your Macs. The new holder, who is bound by this License, receives a new key and the old one is no longer valid. The trial license cannot be transferred.
Warranties
Lifetime license: you benefit from the legal guarantee of conformity for digital content (Articles L224-25-12 et seq. of the French Consumer Code), the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code) and our “Money-back guarantee” commercial guarantee, all described in our terms of sale, as well as any guarantee provided by the mandatory law of your country of residence.
Trial license: as the trial is free and requires no personal data, the legal guarantee of conformity for digital content does not apply to it. You keep your other rights, in particular if we are at fault.
Liability
We are liable to you for the proper performance of our obligations, as provided by law. We are not liable where a failure or damage is attributable to you (in particular use contrary to this License, an incompatible setup or your content), to the unforeseeable and unavoidable act of a third party, or to force majeure within the meaning of Article 1218 of the French Civil Code.
You are solely responsible for your content and how you use it. Nothing in this License limits or excludes the rights you have under the law.
Termination
- You can end this License at any time by removing the Software from your Macs. This does not entitle you to a refund, except as provided in the terms of sale (money-back guarantee, legal guarantees).
- In the event of a serious breach of this License, such as distributing or selling keys, circumventing its protections or holding public screenings, we may terminate it if the breach has not stopped within 15 days of a formal notice sent to you by email.
- When the License ends, you stop using the Software and remove it from your Macs. Your content and your library data remain yours: nothing is deleted from your drives.
If Séance is discontinued
If we were ever to stop developing and distributing Séance for good, we would do our best to keep purchased licenses usable, for example by releasing a final version that no longer requires any license check. Features that depend on third-party services might, however, stop working.
Changes
We may update this License, in particular when we release an update, and we will let you know beforehand. A new version never reduces the rights you have acquired, including the duration of your lifetime license, the number of Macs and the included updates.
Governing law
This License is governed by French law, without depriving you of the protection of the mandatory provisions of the law of your country of residence. Disputes are handled as set out in our terms of sale, including free access to a consumer mediator.
